Currently, under Federal law, it is illegal to possess or build short barreled shotguns and rifles without first registering the possession of these weapons with the Bureau of Alchohol, Tobacco, Firearms and Explosives (ATF) and paying a tax.
Current Delaware law lacks such a requirement, so House Bill 292 will criminalize the possession, sale, transfer, purchase, or receipt unregistered short-barreled shotgun and short-barreled rifles. It will make possession, purchase, receipt or sale of such weapons a Class E violent felony punishable by up to five years in jail.
