The Senate last week passed Senate Bill 77 by a unanimous vote of 21-0. This bill provides protection for liability for a lay individual (i.e. someone who is not a doctor, nurse or EMT) who administers naloxone to a person experiencing an Opioid overdose. This protection from liability for those rendering emergency care to victims is already established under Section 6801 of Title 16, the general Good Samaritan law in the Delaware Code. This Act extends that protection to those administering Naloxone.
Naloxone is a medication designed to rapidly reverse opioid overdose. It is an opioid antagonist—meaning that it binds to opioid receptors and can reverse and block the effects of other opioids. It can very quickly restore normal respiration to a person whose breathing has slowed or stopped as a result of overdosing with heroin or prescription opioid pain medications.
The bill is now in the House Health & Human Development Committee and will be considered once the House comes back next week from Easter Recess.
